1. Introduction
Welcome to MedianCommonsQuadrant ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at mediancommonsquadrant.sbs (the "Service") operated by MedianCommonsQuadrant.
By making a reservation or using our Service, you agree to these Terms. If you do not agree with any part of the terms, access to the Service is not permitted.
2. Service Overview
MedianCommonsQuadrant offers superior yacht charter services, which include but are not limited to:
- Yacht rentals for the day
- Evening boat trips
- Business-related trips
- Exclusive parties
- Extended yacht journeys
All offerings are based on current availability and weather conditions. We retain the right to change or cease services whenever necessary.
3. Booking and Reservations
3.1 Booking Process
To secure a charter, the following is required:
- A minimum age of 18 years
- Submission of valid and complete information
- Payment of the specified deposit included in the booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A charter is only confirmed after payment is received and we issue a written confirmation. We reserve full discretion to decline service to any individual.
3.3 Availability
All charters are dependent on the availability of the vessel and appropriate weather conditions. We strive to honor your requested schedule whenever feasible.
4. Payment Terms
4.1 Pricing
All fees are listed in € and are inclusive of relevant taxes unless specified differently. Prices can be subjected to changes without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter cost, due at the time of booking
- Remaining balance: To be paid 48 hours before the scheduled charter departure
- Other charges (when applicable): To be settled after the charter concludes
4.3 Payment Methods
We accept most credit cards, electronic bank transfers, and certified bank drafts. Our secure, encrypted platforms manage transaction processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Total refund minus processing costs
- Between 24-72 hours before departure: Refund of 50%
- Under 24 hours before departure: No refund provided
5.2 Weather Cancellations
If our captain determines the weather unsuitable for sailing, we can offer:
- An alternative charter date, subject to no extra charge
- A full refund if rescheduling is unfeasible
5.3 Mechanical Issues
Should your designated yacht encounter mechanical issues, we will attempt to arrange an alternative vessel. If an alternative isn't available, we'll issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All travelers must observe the following:
- Adhere to all instructions from the crew
- Utilize provided safety gear as necessary
- Inform us of any health conditions impacting safety
- Stay in designated areas on the boat
6.2 Prohibited Items
The following items are not permitted aboard:
- Containers made of glass
- Illegal items
- Weapons of any type
- Excess beverages (beyond what's considered moderate consumption)
- Animals (unless we provide prior approval)
6.3 Conduct
Travelers are required to behave in a manner that is respectful to others. We reserve the right to discontinue a charter without a refund if a passenger's actions compromise safety or disturb others.
7. Liability and Insurance
7.1 Our Liability
We only accept liability up to the cost paid for your charter. We are not responsible for:
- Injury as a result of passenger negligence
- Loss or damage of personal belongings
- Indirect, secondary, or punitive damages
- Delays due to weather or incidents outside our control
7.2 Insurance Coverage
We maintain extensive insurance for all our vessels and operational activities. Passengers are encouraged to arrange their own travel and personal insurance coverage.
7.3 Assumption of Risk
Engaging in our charter services implies recognition of the inherent hazards of maritime activities, as well as the acceptance of personal accountability for safety and risks.
8. Modifications and Itinerary Changes
We have the right to alter itineraries, paths, or timetables due to weather, security concerns, or operational necessities. Every attempt will be made to offer suitable substitutes when changes are made.
9. Force Majeure
Force Majeure events, over which we have no control, including but not confined to the following, will not hold us accountable for any changes or cancellations:
- Extreme weather conditions
- Natural calamities
- Regulatory orders
- Shut down of ports
- Troubles of mechanical nature
10. Privacy and Data Protection
Your personal data is processed in accordance with our Privacy Policy. Utilizing our services denotes consent to data management as outlined in our Privacy Policy.
11. Intellectual Property
All website content, including text, visuals, logos, and images are defended by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without explicit permission.
12. Governing Law
The application of the law governing these Terms is restricted to Portugal. Disputes arising are to be resolved by courts located in Cascais, Portugal.
13. Changes to Terms
Adjustments to these Terms may be made by us at any time. Any changes will be displayed on our website with a revised date. Continued use of our services will be taken as agreement to the revised terms.
